Another MBNA Success & Query Regarding Claims with Paul Tilley from Quality Solicitors Howlett Clarke 26 Jan 15

I was informed of another MBNA Success using Section 75.  This time one investor had paid £1000 deposit on an MBNA Credit Card and paid the rest by BACS payment.   He had been unsuccessful using Section 75 and writing himself.   He decided to utilise  Mis-sold Specialists who are a company who charge a fee to fight your Section 75 claim and if they are successful, they will take a percentage (I think 25-30%) of your refund as a further payment.

In this case the investor says ” I was refunded the total investment amount plus 8 % on top of the investment in interest, less 29% for Mis-sold Specialists so I only lost a few grand in the end”

I am not supporting or promoting the use of Mis-sold Specialists but clearly this investor is happy that he has a refund and has accepted that Mis-sold Specialists have taken a 29% fee.

On a slightly separate note,

I believe that those who were contacting Paul Tilley from Quality Solicitors Howlett Clarke were also trying to take action against Credit Card firms who were refusing to pay out on Section 75 claims against Asset Land investments.

Does anyone have any news regarding Paul Tilley from Quality Solicitors Howlett Clarke and how your refunds are going?

    I signed up to Paul Tilley’s firm last year after exhausting my considerable efforts with Barclaycard. Howlett Clarke also require a hefty 30% of the amount if successful, which is galling given that others have managed to secure their entire investment without recourse to litigation; however Barclaycard have been stone-walling all requests for refunds I understand. I chased Howlett Clarke for an update last week, and by coincidence they had just written to Barclaycard themselves. There is no indication of time frames. RegardsPeter Peter Cottrell

    Hi Elspeth As you know I have received full refunds on both my so called investments in Asset Land saga. I am very surprised that your MBNA users are having trouble getting theirs back. All they have to say to MBNA under Section 75 claim that as MBNA is doing a statutory duty by giving the full refund they will be able to claim that money back from HMRC against their Corporation Tax payable forthe year in which the refund is made. All MBNA or any other card company has to do is to write off the full refund amount as “an operational cost in the year” when they made the refund. Privately I have used MBNA credit card in the past but did not like their attitude towards their customers as they appeared to me to be very bureaucratic and very long winded and used too many jargons so as to puzzle their customers. The intention being that the customers will not pursue their claims. It was a relief when I ditched them in favour of another good one.     I am pleased for the investors that have got there investment back from there credit cards, unfortunately i paid by cheque for both plots, I wonder how much of Banner Eve and co assets the FCA have got ,The judge ordered them to pay us back ,any chance of that? is there any chance of getting any money back ,

    Re. EDM asking if any progress with Quality Solicitors . Paul Tilley staff drafted letter to NatWest Re claim from me member 11 who had offer of total refund for one or two plots but refused for plots lumped together and ones where deposit was over £ 3,000. Reply to first letter so far has been to repeat original offer. I am waiting patiently, having signed up. Josi
